Terms of Service — Viral Video Hijack

1. Acceptance of Terms

By creating an account or using Viral Video Hijack ("VH", "we", "us", "our"), you agree to these Terms of Service. If you don't agree, do not use the service.

2. What We Do

Viral Video Hijack is an AI-powered content strategy tool that analyzes publicly available viral videos and generates original AI prompts inspired by their structure, pacing, emotion, and script patterns. We do not copy, reproduce, or distribute any original video content. All prompts generated are new, original creative works intended for use on third-party AI video platforms.

3. Your Account

You must provide accurate information when registering. You are responsible for maintaining the security of your account and all activity that occurs under it. You must be 18 years or older to use VH.

4. Subscriptions & Billing

VH offers four membership tiers: Free, Pro Accelerator ($19/month), Studio ($49/month), and Enterprise Operator ($200/month). Subscriptions are billed in advance on a monthly, 6-month, or annual basis depending on your selected plan. Payments are processed securely by our payment provider. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

5. Credit Packs

Credit packs are one-time purchases that add credits to your account. Credits do not expire and carry over indefinitely. Credit packs are non-refundable as they are instant digital deliveries. See our Refund Policy for full details.

6. Acceptable Use

You agree not to use VH to: violate any applicable laws or regulations; infringe on any third-party intellectual property rights; attempt to reverse-engineer, scrape, or copy our platform; generate content intended to harass, defame, or harm others; or circumvent any access controls or usage limits.

7. AI-Generated Content

VH generates prompts using artificial intelligence. You are solely responsible for how you use those prompts and any content you create with them on third-party platforms. We make no warranty that AI-generated content will achieve any specific result, performance, or outcome.

8. No Guarantees

VH provides tools and strategies — not guaranteed results. We make no promises regarding follower growth, video views, page monetization, algorithm performance, or income generation. Results vary based on factors entirely outside our control including but not limited to platform algorithms, content quality, posting frequency, and market conditions.

9. Intellectual Property

All VH software, branding, design, and technology is owned by Smairt.AI. You retain ownership of any prompts and content you generate using our platform.

10. Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms. You may cancel your account at any time through your account settings.

11. Limitation of Liability

To the maximum extent permitted by law, VH and Smairt.AI shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service.

12. Governing Law

These Terms are governed by the laws of the State of California, United States.

13. Changes

We may update these Terms at any time. Continued use of VH after changes constitutes acceptance of the new Terms.
